Warning, Liability Acknowledgment, and Assumption of Risk

You understand that participation in ANY park activity or program created by The Raleigh Homeschool Park Club involves risk of injury or loss of property. These risks include but are not limited to collision with other participants, being hit by ball or bat, allergic reaction, theft, tripping or falling, contracting an infectious (communicable) disease, including COVID-19 virus, physical exertion or other accidents. You further understand that before participating in this or any program, you should consult a physician for advice. By participating, You acknowledge all risks of loss, injury or death and affirm that you are willing to assume responsibility should loss, injury or death result from them. You also agree to follow all park rules and procedures. Furthermore, in return for the opportunity to participate in this park club, you agree for yourself, and for you heirs, assigns, executors and administrators, to waive any legal rights you may have to seek payment from the creator of the Raleigh Homeschool Park Club, Towns where parks are located, its employees or its agents for bodily injury, death, or other loss resulting from this program, and to release those parties from any liability for damages resulting from the loss, injury or death. I understand that no insurance coverage is provided.

You acknowledge that you are responsible for any actions you take while participating in any Homeschool Park Club event. You recognize that your participation and any subsequent actions arising from your participation are taken solely at your own risk.

IN NO EVENT WILL THE RALEIGH HOMESCHOOL PARK CLUB, OUR DIRECTORS, OUR OFFICERS, OUR EMPLOYEES, OUR CONTRACTORS, OUR AGENTS, OR OUR REPRESENTATIVES, BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, OR UNDER ANY EQUITABLE THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
